Albert J. Productions, Inc. provides this site and related services subject to your compliance with the TERMS OF SERVICE set forth below. Please read the following information carefully:
1. ACCEPTANCE OF TERMS
Albert J. Productions, Inc. (to be known as "AJP") shall provide services to you, subject to the following Terms of Service ("TOS"), which may be updated by AJP from time to time without notice to you. The most current version of the TOS may be reviewed at any time at: www.gbucks.com/terms.php. This agreement only applies to the Gbucks Adult Affiliate Program ("Gbucks.com") and does not restrict or supersede any other agreement that may apply to other AJP programs and/or services. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND THE GBUCKS ADULT AFFILIATE PROGRAM. Your completion of the three-part (3-part) Gbucks.com application process shall be confirmation that you have read and understood the TOS and that you have affirmatively given your full acceptance to all of the provisions within the TOS and that you further agree to be legally bound by those terms.
2. DESCRIPTION OF SERVICE
2.1
AJP shall provide and maintain a collection of on-line resources, including membership based adult content web site services (the "Services"), including, but not limited to: Cruiserboys.com; Maximolatino.com; Gaymen.com. Unless explicitly stated otherwise, any new features that augment or enhance the current Services, including the release of new AJP resources, shall be subject to the TOS. Please be aware that AJP has created certain areas on the Services that contain adult or mature content. Access to view these areas will be restricted to persons of at least 18 years of age.
2.2
AJP shall enrol you in the Gbucks Adult Affiliate Program, whereby any membership purchases made by customers referred to AJP by you, through your AJP-provided unique Universal Resource Locator link (URL) shall earn you an affiliate commission rate of fifty percent (50%) of the membership's purchase price, including trial periods and recurring monthly memberships, less any bank processing charges, customer refunds, credits or chargebacks.
2.3
Any membership purchases made through other Gbucks.com affiliates, who were first referred to AJP by you, through your AJP-provided unique Universal Resource Locator link (URL) shall earn you an affiliate commission rate of five percent (5%) of that affiliate's membership sales, including trial periods and recurring monthly memberships, less any bank processing charges, customer refunds, credits or chargebacks.

2.4
Commissions will be calculated twice each month, for the periods beginning on the first (1st) and the sixteenth (16th) day of each calendar month. Commission cheques will be issued on the third (3rd) and eighteenth (18th) day of each calendar month (or the next available regular business day) for the preceding period's earned commissions. All cheques are sent by U.S. Postal Services to the address that you provide to us. As we do not control the postal services, we cannot be held responsible for delays in postal delivery. It is your responsibility to ensure that we have your correct, current mailing address in our files.
2.5
Any bank processing charges, customer refunds, credits or chargebacks that are processed after a commission cheque has been processed will be deducted from the commission cheque total of the next period or periods, until those monies have been fully recovered.
2.6
Commission amounts will be held by AJP on your behalf until an amount of thirty dollars ($30.00) or more has been reached, at which time AJP will then issue a commission cheque to you on the next scheduled processing day.
2.7
Hourly-updated commission statistics will be available for your account online. You may access this information by logging in to your Gbucks.com account at http://www.gbucks.com.
2.8
Posted commission percentages are subject to change by AJP with seven (7) day's notice via electronic mail (email) to the email address that you provided and confirmed during the three-step application process. It is your responsibility to ensure that we always have your current and correct email address.
2.9
Members purchasing services through Gbucks Adult Affiliate Program are deemed customers of AJP. Membership prices and services shall be set solely by AJP and may change without notice, from time to time.
3. ADVERTISING
3.1
It is your responsibility to advertise your Gbucks.com links, however, you are not obligated to promote Gbucks.com or its sites after registration.
3.2
You may promote Gbucks.com and its sites on any number of sites or domains. Your sales will be tracked via your unique Gbucks.com account number and not by site URL.
3.3
All promotional materials must be authorized by an AJP officer in writing prior to their use. If unauthorized materials are used you will forfeit all commissions as yet unpaid. Please note that materials produced by AJP have already been approved for your use.
3.4
You agree to indemnify and hold AJP, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, safe and harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your Content, your use of the Services, your connection to the Services, your violation of the TOS, or your violation of any rights of another.
3.5
You agree to hold AJP safe and harmless in any litigation of unauthorized advertising techniques to which you may become a party.
3.6
AJP may hold you liable for fines, etc. up to or exceeding $10,000.00 for the use of any illegal material in advertising efforts if AJP, is prosecuted for said material.
3.7
In addition, AJP may immediately terminate your participation in Gbucks.com, forfeiting any monies earned and not yet paid, if we believe you have engaged in any of the following:
a) Any form of spamming including, but not limited to unsolicited email, IRC postings, newsgroups, and/or instant messaging clients;
b) Promotion of Gbucks.com Program websites on password sites, MP3 sites or warez sites, child pornographic sites, or any other illegal websites;
c) Promotion of, and/or providing adult content intended to be viewed by children, or youth under the age of 18;
d) Promotion of, and/or providing content depicting violence;
e) Promotion of, and/or providing content that is illegal or of a questionable nature;
f) Violating intellectual property rights.
4. ADDITIONAL TERMS
You agree that AJP shall not be responsible for the loss of any economic opportunity caused by any downtime due to server maintenance, Internet congestion, or any other related Internet problems.

You agree that AJP reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that AJP shall not be liable to you or to any third party for any modification, suspension or discontinuation of the Services (or any part thereof).

You agree that AJP has the right not to accept any Gbucks.com affiliate applicant at its sole discretion.

You agree that AJP, in its sole discretion, may terminate your password, account, use of the Services or use of any other AJP service, for any reason, including, without limitation, lack of use or if AJP believes that you have violated or acted inconsistently with the letter or spirit of the TOS. You agree that any termination of your access to the Services under any provision of this TOS may be effected without prior notice, and acknowledge and agree that AJP may immediately deactivate or delete your Gbucks account. Further, you agree that AJP shall not be liable to you or any third-party for any termination of your access to the Services.

You agree that this agreement can be terminated by AJP at anytime for any reason, if in AJP's opinion you have not fulfilled your obligations and responsibilities, and that you may forfeit all unpaid commissions to AJP

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, or access to the Services.
10. FORCE MAJURE
This TOS constitutes the entire agreement between you and AJP and governs your use of the Services, superseding any prior agreements including, but not limited to, any prior versions of the TOS. You also may be subject to additional terms and conditions that may apply when you use affiliate or other AJP services, third-party content or third-party software. The laws of the State of California shall govern the TOS and the relationship between you and AJP. You and AJP agree to submit to the personal and exclusive jurisdiction of the courts located within the county of San Diego, California. The failure of AJP to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the TOS are for convenience only and have no legal or contractual effect.
